Over the next several issues, Winning with E-mail
will provide an overview of the entire CAN-SPAM
Act of 2003. However, for those that have upcoming
e-mail distributions, use these five basic requirements
to ensure your e-mail messages are CAN-SPAM compliant:

Provide notice the e-mail
is a Solicitation or Promotion. |

A clear notification that the message is
a commercial solicitation or promotion is
required. It is recommended that you place
a conspicuous "ADV" in the subject
line.
It is important to note that the "ADV"
is not required if the recipient has “expressly
consented” to receive the e-mail message. |

Do not use misleading subject lines.

Cleary state the content of the e-mail in
the subject line. |
| 3) |
Do not use false e-mail headers. |
| |
Do not use false e-mail header information
including From, Return, and Reply addresses,
hostnames, or IP address(es). |
| 4) |
Include a Valid physical postal address.

| |
A valid physical postal address of where
the recipient can contact the advertiser or
list owner is now required on every e-mail. |
| 5) |
Include an Unsubscribe process. |
| |
The law requires that every e-mail message
include a process to unsubscribe. In addition,
the e-mail address must be removed from the
list within 10 days of the request. |
