CAN-SPAM
Act of 2003
Winning with Email,
January 2004
by Michael Wacht
SPAM is no longer just a nuisance - it’s
Illegal.
On January 1, 2003, President Bush signed the
CAN-SPAM Act of 2003 making SPAM illegal. The
penalties for sending SPAM range from monetary
fines, forfeiture of computer equipment, to imprisonment.
Why such drastic measures?
| There are three contributors: |
| 1) |
Over 50% of all email sent today
is SPAM. |
| 2) |
SPAM threatens the use of arguably the most
prolific business tool in modern history. |
| 3) |
Consumers and corporations spend billions
of dollars weeding through emails and deploying
technology to filter SPAM. |
While some feel that the CAN-SPAM Act did not
go far enough, we are of the opinion that it is
fair legislation, and a good first step. It was
well thought-out and strikes a balance between
the goals of legitimate marketers while protecting
both consumer and corporate resources.
